National Mortgage Servicing Settlement includes $20 Billion

Update National Mortgage Servicing Settlement

 We wanted to issue an update within the next week on the National Mortgage Settlement specifically within that agreement the Servicing Settlement.  My reason for updating you on the modification guidelines if you did not read click here:  MODIFICATION is because even IF you are unemployed you maybe able to receive help thanks to this settlement.

SERVICING CATEGORIES FOR SETTLEMENT:

The total breakdown are in categories of Principal Reduction with a $10 Billion settlement, $3 Billion for refinancing, and $7 Billion for other forms of relieve which we will discuss. In addition, are funds for military.

PRINCIPAL REDUCTION:

The Principal Reduction are for those delinquent or in danger of being delinquent and owe more than their homes current market value.  The Servicing Settlement allots $10 Billion for relief to borrowers.

REFINANCING:

Refinancing allots require eligibility via basic needs that will lower the loan interest rate and intern lower mortgage payment amounts. This is great for those in adjustable rate mortgage to help lower there home loan. Settlement agreement for this program are $3 Billion.

OTHER FORMS ASSISTANCE:

Other forms category includes help for homeowners needing transitional assistance to walk away, benefits for service members active and inactive (service member benefits are well deserved and complete details will be discussed in another article settlement is over $5 billion), additional service benefits are for those away from home experiencing Hostile Fire and Imminent Danger Pay. Other forms also includes assistance for forbearance of principal for unemployed homeowners, and anti-blight programs and is allotted $7 Billion.

What does this mean? It means even though you may have been denied a loan modification there could now be a program to assist you if you have one of the lenders below.

Loan Modification

LOAN MODIFICATION:

Home loan modification guidelines vary from lender to lender and within one lending institution there can be a variety of mortgage pre foreclosure options that determine which Loan Modification program you are eligible for.  

LOAN MODIFICATION PROGRAM APPROVAL: 

Home loan modification pre-approval can be preliminary base on questions that determine which type of program you are eligible for.  Final approvals for foreclosure prevention help in the form of a loan modification is determined by a few factors such as:

  • Monthly Income
  • Hardship
  • Affordability of Home at Current Income
  • Is hardship issue temporary or permanent

Can Mortgage Loans Be Written Off?

CAN HOME LOANS BE WRITTEN OFF

The question we have been asked in the industry is can Mortgage Loans be written off and what does that mean?

Have you stopped receiving calls from the lender? Are you receiving calls from a different lender? Did you receive a notice from a management company? Chances are your current lender/servicer has changed and/or changed the company that handles your loan.

If you receive a letter or do a credit pull and your past lender/servicer (which you think is still the servicer/lender) information on file says "CHARGED OFF" that means your loan amount has been transferred. So what NOW???

Do you have to pay? Who do you pay? Don't know who the lender is? We are responding to questions we have received in the office numerous times so I hope this helps.

  •   Do you have to pay?   The debt is still valid so yes, BUT sometimes the amount and or  
  •   payment  is reduced.

  •  Who  you pay is usually provided from the past lender.  Normally, they will inform you of
  • the  transfer, the new lender name and address, after this the new servicing company/lender usually contacts via phone, e-mail, or visit to home to inform you to contact them regarding the loan. 
*** IF you have been denied a modification REMEMBER your loan has been "Charged Off" despite your frustrations this time the new servicer maybe willing to modify the payment terms so this may be GREAT NEWS!  Take the time to send in ALL requested information****

For those who have no idea who the lender is and they have not made contact SAVE YOUR CASH.   Some benefits of a "Charged Off"  Mortgage sometimes you are allowed a discounted loan reduction for numerous reasons  or a reinstatement fee and a loan amount that you can afford.

Countrywide Financial Corporation Settlement $335M

COUNTRYWIDE FINANCIAL CORPORATION SETTLEMENT

Countrywide Financial Corporation Settlement is in response to United States vs Countrywide Financial Corporation discrimination settlement being handled by Rust Consulting Inc. payment amount is $335 Million this is NOT the same or including the billion dollar settlement.

The settlement is a U.S. District Court of Central California approved settlement being handled by the administrator Rust Consulting as the contact and distributor of compensation payments to homeowners. Rust Consulting activities are governed by the Department of Justice. ALLEGATIONS

In addition, discrimination case is based on the basis encouragement of non-applicant spouses. Countrywide Financial Corporation and it's subsidiaries encouraged signing away of rights to joint applicants applying for loans.

HOW TO APPLY/DEADLINE

Victims were identified (we do not have the criteria for how this process was initiated or determined) and letters began being sent on November 16, 2012 to those whom the United States identified as entitled.

March 29, 2013 is the DEADLINE to have all letters signed and response forms completed and mailed.

COMPENSATION

Mid 2013 the exact payment amount will be released.

$35 Million Payout Florida Based Lender Processing DocX

A $35 Million payout in Florida based LPS Lender Processing Services Inc. subsidiary DocX LLC has been agreed upon. DocX the subsidiary of LPS is a publicly traded Mortgage Servicing Company located in Jacksonville, Florida. LPS subsidiary DocX has agreed to pay $35 Million in criminal penalties and forfeiture in a six-year scheme to prepare and file more than 1 million fraudelently signed and notarized mortgage related documents with the property recorder's office. DocX LLC Lorraine Brown former CEO plead guilty to the leadership role in the conspiracy to commit mail fraud and wire fraud.

Docx LLC documents included mortgage assignments, lost note affidavits, lost assignment affidavits were later relied upon in court, property foreclosures, and Federal bankruptcy actions to ready more visit JACKSONVILLE DIVISION . The discovery of this disposition of DocX LLC as well as the other multi-billion dollar settlement is part of the efforts and implementation from our Chief and Commander President Obama Financial Fraud Enforcement Task Force (FEETF). FEETF was established to wage an aggressive proactive effort to investigate and prosecute fraud crimes for consumers. This is CHANGE that will help prevent issues not only now, but in the future and at the least provide a form of protection to current and future homeowners.
